Terms of Service

By registering an account, browsing, purchasing, or selling on PlayerTradeHub, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional policies referenced herein. If you are using the Platform on behalf of a business or organisation, you represent that you have full authority to bind that entity to these Terms.

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to use the Platform. By using the Platform, you represent and warrant that you meet this requirement. Residents of jurisdictions where the use of this Platform is prohibited by applicable law are not authorised to use it. We reserve the right to terminate accounts if we have reasonable grounds to believe a user does not meet eligibility requirements.

To access certain features you must create an account. You agree to:

• Provide accurate, current, and complete information during registration and keep it updated
• Keep your login credentials strictly confidential and not share them with any third party
• Immediately notify us at [email protected] of any suspected unauthorised access
• Accept full responsibility for all activities conducted under your account, whether authorised by you or not
• Not create multiple accounts to circumvent bans, restrictions, or promotional limits

We may suspend or terminate accounts at our sole discretion, including for suspected fraud, violation of these Terms, prolonged inactivity, or at the request of law enforcement.

We may require you to complete identity verification ("Know Your Customer" or KYC) in circumstances including but not limited to: high-value transactions, withdrawal requests above certain thresholds, suspected fraudulent activity, or requests from Stripe or law enforcement.

• KYC may require submission of a government-issued photo ID and proof of address
• Failure to complete KYC within a reasonable timeframe may result in transaction holds, account restrictions, or account closure
• KYC documents are encrypted, stored securely, and used solely for identity verification — they will not be shared with third parties except as required by law or by Stripe's own compliance requirements
• Submitting false, fraudulent, or altered identity documents is a criminal offence and will result in immediate permanent account termination and referral to law enforcement

If you have a dispute with another user, you must attempt resolution through our built-in dispute system before seeking any external remedy. We will review disputes and may make binding decisions at our sole discretion. Our dispute decisions do not constitute legal advice or an adjudication by a court, arbitral tribunal, or regulatory body. PlayerTradeHub reserves the right to freeze relevant funds pending investigation. Opening a chargeback or initiating external legal proceedings before or during our dispute process is a violation of these Terms.

You agree not to engage in any of the following:

• Violating any applicable local, national, or international law or regulation
• Transmitting unsolicited commercial communications (spam)
• Attempting to gain unauthorised access to any part of the Platform, its infrastructure, or other users' accounts
• Using automated tools, bots, or scrapers to access, collect data from, or interact with the Platform without our prior written consent
• Impersonating any person, entity, or PlayerTradeHub staff member
• Interfering with or disrupting the integrity, security, or performance of the Platform or its underlying infrastructure
• Attempting to reverse-engineer, decompile, disassemble, or extract source code from the Platform
• Facilitating or enabling any third party to commit any of the above acts

All content on the Platform — including text, graphics, logos, icons, images, audio, and software — is the property of PlayerTradeHub or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works, sublicence, publicly display, or commercially exploit any Platform content without our prior written permission. User-submitted content (listings, images, reviews) remains the property of the submitting user; by submitting you grant PlayerTradeHub a worldwide, royalty-free, non-exclusive licence to use, display, and distribute that content for the purpose of operating the Platform.

Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform you consent to the collection, processing, and use of your personal data as described in that policy. We comply with applicable data protection laws including the GDPR where relevant.

The Platform and all services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, accuracy, or non-infringement. We do not warrant that:

• The Platform will be uninterrupted, timely, secure, or free from errors or viruses
• Any results obtained from use of the Platform will be accurate, reliable, or meet your requirements
• Third-party sellers will fulfil orders as described or at all
• Digital keys will be compatible with your device, account, or region
• The Platform will be free from harmful components introduced by third parties

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot be excluded or limited under applicable law.

To the fullest extent permitted by applicable law, PlayerTradeHub and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to loss of profits, revenue, data, goodwill, business opportunity, or other intangible losses — arising out of or in connection with:

• Your use of, or inability to use, the Platform
• Any transaction between you and another user
• Unauthorised access to, or alteration of, your data or transmissions
• Conduct of third parties on the Platform
• Any bugs, viruses, or malicious code transmitted through the Platform by any third party

Our total aggregate liability to you for any and all claims arising under or in connection with these Terms shall not exceed the greater of (a) the total platform fees paid by you to PlayerTradeHub in the twelve months preceding the event giving rise to the claim, or (b) USD $100. This limitation applies regardless of the legal basis of the claim (contract, tort, statute, or otherwise) and even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless PlayerTradeHub and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with:

• Your use of or access to the Platform
• Your violation of these Terms or any applicable law or regulation
• Your violation of any third-party rights, including intellectual property, privacy, or contractual rights
• Any fraudulent, deceptive, or unlawful conduct on your part
• Any content you submit to, post on, or transmit through the Platform

The Platform integrates with third-party services including Stripe (payment processing), NowPayments (cryptocurrency), Kinguin (digital key distribution), and others. Your use of these services is subject to their respective terms and privacy policies. PlayerTradeHub is not responsible for the acts or omissions of any third-party service provider, including payment processor failures, key supplier errors, or data breaches at third-party systems.

We may suspend or terminate your access to the Platform at any time, with or without notice, for any reason, including but not limited to violation of these Terms, fraudulent activity, chargebacks, or prolonged inactivity. Upon termination:

• All licences granted to you will immediately cease
• Any pending orders will be handled in accordance with our dispute and refund policies
• Any balance held in your seller account may be withheld pending resolution of open disputes or chargebacks

Provisions that by their nature should survive termination — including Sections 10, 12, 13, 14, and 17 — shall survive.

These Terms are governed by and construed in accordance with applicable law. You agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform that cannot be resolved informally shall be subject to binding arbitration or, where arbitration is not available, the courts of competent jurisdiction. You waive any right to participate in a class-action lawsuit or class-wide arbitration against PlayerTradeHub. Nothing in this clause prevents either party from seeking emergency injunctive relief before a court of competent jurisdiction.

We may revise these Terms at any time. We will provide notice of material changes by posting updated Terms on this page, updating the "Last updated" date, and, where reasonably practicable, notifying registered users by email. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform.

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remainder of these Terms shall continue in full force and effect. These Terms (together with the Privacy Policy and any additional policies incorporated by reference) constitute the entire agreement between you and PlayerTradeHub with respect to the subject matter herein and supersede all prior or contemporaneous communications.
